Buyer’s Premium / Sales Tax

An 18% buyer’s premium and 6% applicable sales tax will be added to the final hammer price on all purchases. The buyer’s premium is in addition to the winning bid. By registering and bidding, you expressly authorize the Auction Company to charge the full invoice amount (including buyer’s premium, sales tax, and any other applicable fees) to the credit card on file immediately upon the close of the auction, without further notice or approval.

Auction Timing & Closing Procedures

This is a timed auction. The first lot will close at the published closing time. Each subsequent lot will close at approximately 15–20 second intervals, in consecutive order. Due to the number of lots offered, the auction may take several hours to fully conclude. The Auction Company is not responsible for bidder misunderstanding of auction timing or lot closing order.
Important Notice: Being the high bidder at any given time does not guarantee you will win the lot. Bidders are solely responsible for monitoring the auction and submitting bids in a timely manner. The Auction Company is not liable for missed bids due to bidder inattention, internet delays, platform issues, or technical malfunctions.

Extended Bidding ("Soft Close")

Extended bidding (also known as a “soft close”) is utilized to promote fair competition. If a bid is placed within the final one (1) minute of a lot’s scheduled closing time, the bidding period for that lot will automatically extend by two (2) additional minutes. This extension will continue until no further bids are placed. The lot will then be sold to the highest bidder. All bidding platform clocks and extensions are controlled solely by the Auction Company and/or its bidding platforms and are final.

Bidder Responsibility & Binding Contract

By registering for and participating in this auction, you acknowledge, understand, and agree to the following terms:
Binding Agreement: Each bid placed constitutes an irrevocable offer and a legally binding contract to purchase the item at the bid price plus buyer’s premium, sales tax, and any applicable fees.
No Bid Retractions: All bids are final and may not be withdrawn, canceled, or altered for any reason, including bidder error.
No Refunds or Chargebacks: All sales are final. No refunds, exchanges, cancellations, or chargebacks will be permitted. Initiating a chargeback constitutes a breach of these terms and may result in legal action, permanent bidding bans, and recovery of associated costs.
AS IS, WHERE IS: All items are sold AS IS, WHERE IS, with all faults and defects, whether known or unknown. The Auction Company makes no representations or warranties of any kind, expressed or implied.
No Rescission Rights: The highest bidder expressly waives any right of rescission, revocation, refund, or exchange. All sales are absolute and final.

Inspection & Condition of Items

Inspection Responsibility: Bidders are solely responsible for inspecting items prior to bidding and determining condition, authenticity, value, and suitability. Photographs, descriptions, and condition reports are provided for convenience only and are not guarantees.
Acceptance of Condition: By placing a bid, you acknowledge that you have either inspected the item or waived your right to inspect and accept the item in its present condition.

Governing Law & Jurisdiction

This auction is conducted in accordance with the laws of the Commonwealth of Pennsylvania. By bidding, you agree that any dispute arising from this auction shall be governed by Pennsylvania law and that exclusive venue and jurisdiction shall lie in the courts located within Pennsylvania.

Credit Card Authorization, Non-Payment & Default

All purchases will be charged to the credit card on file immediately at the close of the auction. If the credit card is declined, invalid, or payment cannot be processed for any reason, the bidder is deemed to be in default.
Default Consequences: In the event of non-payment, the Auction Company may, at its sole discretion, cancel the sale, retain any deposits, resell the item(s) without notice, pursue legal remedies, and hold the bidder liable for any deficiency, costs, commissions, and damages incurred.
Non-paying bidders will be permanently flagged and reported to all affiliated bidding platforms, including but not limited to BidWrangler, HiBid, Proxibid, and the Pennsylvania Auctioneers Association, and may be banned from future auctions.

No Shipping / Pick-Up Requirements

Pick-Up Only: No shipping, freight, or delivery services will be provided under any circumstances. Buyers are solely responsible for pickup, loading, labor, equipment, and removal of purchased items.
Forfeiture: Items not picked up within the days specified in the auction will be deemed abandoned, forfeited without refund, and may be disposed of, resold, or retained by the Auction Company at its sole discretion. Storage fees may apply at the Auction Company’s discretion.

Limitation of Liability

The Auction Company shall not be liable for any loss, damage, or delay caused by acts of God, internet or platform failures, clerical errors, bidding platform malfunctions, or any other circumstances beyond its control.

Acceptance of Terms

Registration and participation in this auction constitute full acceptance of all terms and conditions herein, without exception.
